Blake Lively won part of and lost part of her motion for a protective order in the Blake Lively v. Justin Baldoni lawsuit filed in New York Federal Court. Today, Judge Liman issued his ruling—following oral arguments last Thursday, March 6, 2025. The Court entered a protective order that limits what documents may be designated Attorneys’ Eyes Only to four specific categories: 1. Trade secret information2. Medical records of parties or third parties3.Security measures taken by parties or third parties4. Highly personal and intimate information about third parties, as well as highly personal intimate information about parties—except where such information is directly relevant to the truth or falsity of any allegation in the complaints in the case. Judge Liman emphasized that, despite these limitations, discovery inherently involves a broad exchange of sensitive, personal, and intimate information. He also made clear that before designing materials Attorneys’ Eyes Only, the producing party bears the burden of ensuring that the information is not directly relevant to any allegations in the pleadings. Keith and Stewart break down Judge Liman’s order.
